    LOOK: Supreme Court to favor Duterte’s martial law proclamation?

    The Supreme Court is likely to rule out as “constitutional” President Rodrigo Duterte’s Proclamation 216 last 23rd of May, which puts the entire Mindanao under martial law. That is after, majority of the magistrates in the highest court believe that Duterte’s martial law is founded on factual and sufficient basis.


    According to the unimpeachable sources of The Manila Times, “an overwhelming majority of the justices are set to affirm the legality of Proclamation 216” that was issued by Duterte and has suspended, for the whole Mindanao, the privilege of the writ of habeas corpus.

    On July 4, Supreme Court members are bound to cast votes during an en banc session. 

    The court insiders of The Manila Times (who asked not to be identified) also revealed that “a well-crafted draft decision” drafted by Associate Justice Mariano del Castillo posits that Duterte be absolved from charges of so-called “abuses” regarding his prerogative to declare martial law.

    Several members of the high court had expressed approval and agreement on del Castillo’s 83-page draft decision while other justices had drafted their own separate opinion about the issue. Among them were Chief Justice Maria Lourdes Sereno, Justices Antonio Carpio, Diosdado Peralta, Estela Perlas-Bernabe, Bienvenido Reyes and Marvic Leonen.

    The Manila Times insiders had also asserted that around 10-14 Supreme Court justices are likely to vote in favor of the constitutionality of the martial law.

    The informant also revealed that so far, only one magistrate had expressed dissenting opinion to the decision drafted by del Castillo. As for this dissent, the main argument presented focuses on the scope of Duterte’s proclamation, claiming that martial could have been “confined” to Lanao del Sur and some nearby areas surrounding Marawi City.


    If so, that the SC rules out martial law to be constitutional, all criticisms fired by the opposition and its stalwarts will surely backfire and SC’s affirmation of Duterte’s proclamation would “hypothetically” slap their faces.
